Terms of Sale

8.                           Eligibility

You must be over 18 years of age to purchase alcohol. By placing an order, you warrant you are at least 18 years old. These Terms of Sale (Terms) apply to your order and supply of products and services by us to you. To the extent permitted by law, no other terms are implied by trade, custom, practice or course of dealing.

9.                           Registration

To use some of the services or features on the Website you will need to register. When you register you are required to provide information about yourself that is current and complete. You must notify us of any changes to your details.

10.                     Orders

10.1               All orders are subject to acceptance and availability. We reserve the right to cancel or refuse any order at our discretion. Pricing is in Australian dollars (AUD) and includes GST unless otherwise stated.

10.2               Each order is an offer by you to buy the goods specified in the order (Products) subject to these Terms.

10.3               Please check the order carefully before confirming it. You are responsible for ensuring that your order is complete and accurate.

10.4               Our acceptance of your order takes place when we send an email to you to accept it (Order Confirmation), at which point and on which date the contract between you and us will come into existence. The contract will relate only to those Products confirmed in the Order Confirmation.

10.5               If we are unable to supply you with the Products for any reason, we will inform you of this and we will not process your order. If you have already paid for the Products, we will refund you the full amount.

10.6               We reserve the right not to accept your order for any reason including that we are unable to obtain authorisation for payment, that shipping restrictions apply to a particular item or destination, that the item ordered is out of stock or that you do not meet the eligibility criteria set out within these Terms.

10.7               All purchases are for personal use only and we reserve the right to cancel any orders that we consider or deem to be for the purposes of commercial use or re-sale.

10.8               Should you place an order for an item with a pricing error, we reserve the right to cancel that order.

10.9               Occasionally, we may be waiting for additional stock from our suppliers. We will attempt to notify you of the expected delivery date.

10.10         We may withdraw any item listed for sale on the Website including if any Product becomes unavailable, is withdrawn by the distributor or supplier, as incorrectly listed on the Website or if we otherwise decide.

11.                     Payment

Full payment must be received before Products ordered are dispatched.

12.                     Delivery and Shipping

12.1               We deliver Australia-wide, subject to applicable restrictions in your state or territory. Delivery timeframes are estimates and not guaranteed.

12.2               In order to comply with liquor laws an adult over the age of 18 years must be present to accept the delivery and may be required to present appropriate identification.

13.                     Cancellations & Returns

14.                     Limitation of Liability

To the extent permitted by law, our liability is limited to the resupply or refund of the purchase price of the Products. These Terms do not limit your rights under the Australian Consumer Law.

15.                     Amendments

We may update these Terms at any time. Continued purchases signify your agreement to the latest version.

16.                     Governing Law

These terms and conditions, their subject matter and their formation, are governed by New South Wales law. You and we both agree that the courts in New South Wales will have exclusive jurisdiction.
